Welcome to Falcon Pest Control ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website at www.falcon-pest.com (the "Site") and all pest control services, inspections, and treatments provided by Falcon Pest Control (the "Services").

By requesting, scheduling, or receiving our Services, accessing our Site, or opting into our SMS communications, you ("Customer," "you," or "your") agree to be bound by these Terms.

Services Provided

Falcon Pest Control agrees to provide pest management and inspection services as described in your individual Service Agreement, invoice, or work order. Services cover only the specific pest(s) identified in your agreement.

SMS and Text Messaging Program (A2P Compliance)

A. Program Name & Description

• Program/Brand Name: Falcon Pest Control Notifications
• Program Description: By providing your phone number and opting in, you consent to receive SMS/MMS text messages from Falcon Pest Control regarding appointment reminders, service updates, technician arrival notifications, billing statements, and account alerts.

B. Message Frequency & Rates

• Message Frequency: Message frequency varies based on your service schedule and account activity (e.g., upcoming service reminders, completed service reports, or invoice notifications).
• Cost Disclosure: Message and data rates may apply depending on your mobile carrier and wireless plan.

C. Opt-Out & Customer Support Instructions

• Opt-Out (STOP): To stop receiving text messages at any time, reply STOP to any text message sent from Falcon Pest Control. You will receive a one-time confirmation message confirming that you have been unsubscribed, and no further messages will be sent to your mobile device unless you opt back in.
• Customer Support (HELP): For help or questions regarding our text messaging program, reply HELP to any message, or contact our customer support directly at (682) 439-3084 or via email at javier.sanchez@falcon-pest.com.

D. Carrier Liability Disclaimer

• Carriers are not liable for any delayed or undelivered messages.

Customer Responsibilities

To ensure safe and effective treatment, the Customer agrees to provide clear access to interior/exterior areas and follow all pre-service prep instructions (such as keeping pets and children indoors during application).

Pricing & Payment Terms

• Payment Due Date: Payment for one-time services or recurring plan visits is due upon completion of the service.
• Auto-Pay Plans: If enrolled in a recurring service plan, your payment card on file will be automatically charged following each completed service visit.
• Late Payments: Unpaid invoices past 30 days are subject to a late fee of 1.5% per month (or the maximum allowed by Texas law) until paid in full.

Cancellations & Guarantees

If you need to cancel or reschedule an appointment, you must notify us at least 24 hours prior to the scheduled service time to avoid potential service call fees.

Privacy & Data Handling

Your privacy is very important to us. We do not sell or share your personal information or mobile opt-in data with third parties for marketing purposes. For full details on how we collect, use, and protect your information, please view our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by Texas law, Falcon Pest Control's total liability for any claim arising out of or related to our Services shall not exceed the total amount paid by the Customer for the specific service visit in question.

Governing Law

These Terms shall be governed by, construed, and enforced in accordance with the laws of the State of Texas, with venue in Tarrant County, Texas.
